Gift Card Terms and Conditions

§ 1. Definitions

  1. Exhibitor – MK Studio Michał Gatner with its registered office in Dobrzykowice at ul. Ametystowa 7, 55-002 Dobrzykowice, NIP: 6191950507, REGON: 300251230,
  2. Online Store – an online store run by the Exhibitor, available at: https://posterimo.com ,
  3. Gift card - a product voucher (represented by an alphanumeric code) issued in electronic form, entitling the User to purchase any Goods offered in the Online Store, up to a maximum amount corresponding to the nominal value of the voucher,
  4. Buyer – the person purchasing the Gift Card via the Online Store,
  5. User – Purchaser or any holder of a Gift Card who makes a transaction in the Online Store using the Gift Card,
  6. Goods – a product presented by the Exhibitor via the Online Store, which may be the subject of a Transaction concluded with the Buyer,
  7. Issue – the initial introduction of the Gift Card into circulation by the Issuer through a purchase by the Purchaser,
  8. Transaction – a sales agreement concluded at a distance, on the terms specified in the Regulations of the Online Store , between the User and the Issuer,
  9. Regulations – these regulations for Gift Cards in the online store posterimo.com
  10. Online Store Regulations – regulations of the Online Store regulating the method of concluding Transactions, available at: https://posterimo.com/policies/terms-of-service .

§ 2. General conditions

  1. These Terms and Conditions define the terms and conditions for the purchase and use of Gift Cards.
  2. A gift card, as defined by applicable legal regulations, is not an electronic payment instrument or an electronic payment card. A gift card is a form of a voucher for purchases in the Online Store.
  3. The Gift Card issued is a multi-purpose voucher within the meaning of the provisions of the Act of 11 March 2004 on tax on goods and services, and therefore the Issuance of Gift Cards does not constitute a Transaction subject to VAT within the meaning of applicable tax regulations.
  4. In exchange for the funds received from the Purchaser, the Issuer undertakes to provide the Purchaser with a Gift Card and to accept the Gift Card as payment for all or part of the purchases of Goods made in the Online Store.
  5. Using the Gift Card, the User may make Transactions only in the Online Store by purchasing any Goods available in the Online Store.
  6. The Gift Card cannot be exchanged for cash in whole or in part. This also applies if the funds on the Gift Card have not been used within the Gift Card's validity period.
  7. The Issuer issues Gift Cards to the bearer and therefore does not bear any liability for the use of the Gift Card by third parties, nor for the loss or damage of the Gift Card for reasons beyond the control of the Issuer, occurring after its transfer to the Purchaser.
  8. The Gift Card is valid and active for a period of 1 year (understood for the purposes of these Regulations as 365 calendar days) from the date of purchase of the Gift Card. After the above period, the Gift Card loses its validity and it will no longer be possible to make Transactions using it.
  9. Activation of the Gift Card occurs automatically at the time of its purchase by the Purchaser. From the moment of activation of the Gift Card, the Purchaser may make Transactions using the Gift Card.

§ 3. Rules for purchasing Gift Cards

  1. The gift card is only available via the Online Store.
  2. In order to purchase a Gift Card, the Purchaser will be obliged to add the Gift Card of their choice to the shopping cart in the Online Store and make the payment in the manner specified in the Regulations of the Online Store.
  3. The purchaser can choose the value of the Gift Card from the available denominations:
    1. 100.00 PLN;
    2. 150.00 PLN;
    3. 200.00 PLN;
    4. 300.00 PLN;
    5. 500.00 PLN;
    6. 1000.00 PLN;
  4. Payment for the Gift Card can be made in any form available in the Online Store.
  5. Once payment for the Gift Card has been received, the Issuer will send the gift card to the email address provided by the Purchaser.

 

§ 4. Rules for using the Gift Card

  1. The redemption of a Gift Card involves the purchase of Goods offered in the Issuer's online store and payment of the purchase price for the Goods using the funds stored on the Gift Card.
  2. The card can only be topped up once.
  3. The Buyer does not have to be a registered user of the Online Store in order to make a Transaction. The method of making a Transaction in the Online Store is specified in the Online Store Regulations.
  4. The Gift Card may be redeemed in any number of Transactions up to the amount of the balance available on the Gift Card.
  5. The Online Store is entitled to request proof of authorisation to use the Card by presenting a digital message with an alphanumeric code, and in the event of the User refusing to provide the above, it is entitled to refuse to make a transaction using the Card.
  6. The Card cannot be exchanged for cash in whole or in part, and the funds corresponding to the balance on the Gift Card account do not accrue interest.
  7. The Gift Card is not an electronic payment instrument, an electronic money instrument or a payment card.
  8. When redeeming a Gift Card, the User is not entitled to receive change in cash if the value of the Goods received is lower than the current value of the Gift Card. The remaining, unused value of the Gift Card remains available for use by the User during the validity period of the Gift Card.
  9. The current face value of the Card remaining after a transaction made using the Card may be used by the User during the validity period of the Gift Card.
  10. At the time of payment, the Card balance is reduced by an amount equivalent to the price of the purchased goods.
  11. If the funds collected on the Card are not sufficient to pay for the purchased goods, the User is obliged to pay the difference using another payment method accepted in the Online Store.
  12. The Issuer is entitled to refuse the redemption of a Gift Card in the event that:
    1. The Gift Card has expired,
    2. The User's actions violate the Terms and Conditions or when the User has taken any action aimed at bypassing the security measures used by the Publisher or involving data falsification,
    3. The gift card has already been used.

§ 5. Complaints

  1. Complaints related to the sale of Gift Cards should be submitted directly to the Issuer by sending an e-mail to the following address: reklamacje@posterimo.com .
  2. All complaints related to the purchase and use of Gift Cards will be considered by the Issuer within 14 days from the date of submission of the complaint.
  3. The User may contact the Issuer regarding the services provided under these Regulations in the following manner:
    1. by mail to the address: MK Studio, ul. Ametystowa 7, 55-002 Dobrzykowice,
    2. electronically to the e-mail address: reklamacje@posterimo.com .
  4. The User may file a complaint if the services specified in the Regulations are not provided or are provided in a manner inconsistent with the provisions of the Regulations.
  5. Complaints regarding Goods purchased using the Gift Card should be submitted in the manner specified in the Regulations of the Online Store.

§ 6. Withdrawal from the contract

  1. The purchaser has the right to withdraw from the Gift Card purchase agreement and may return it within 14 days of receiving the Gift Card.
  2. The form of submitting a declaration of withdrawal from the Gift Card purchase agreement is specified in the Online Store Regulations. After receiving the Purchaser's declaration of withdrawal from the Gift Card purchase agreement and returning the Gift Card, the Issuer shall verify whether the Gift Card that the Purchaser wishes to return is active, i.e. whether it has not already been used during a Transaction in the Online Store.
  3. After positive verification, referred to in § 6. paragraph 2 of the Regulations, the Issuer returns the value of the Gift Card to the Purchaser to the indicated bank account from which the payment for the Card was made or in another manner in accordance with the Purchaser's request, and the Gift Card is deactivated.
  4. If the User exercises the right to return Goods purchased using a Gift Card, the value of the returned Goods will be refunded by issuing a new Gift Card.
  5. In the event of exercising the right to withdraw from the contract, under the terms and conditions specified in the regulations of the online store, the refund is made using the same payment methods that were used in the original transaction, therefore, in the event of paying for the order with a Card or Cards, the User receives another Card with a value corresponding to the amount debited from the Card or Cards used to pay for the order.

§ 7. Final provisions

  1. The content of these Regulations is available at: https://www.posterimo.com/ .
  2. At the express request of the User, the Issuer may send the Regulations to the User in the form of an e-mail message to the e-mail address provided by the User.
  3. By making a purchase, the Purchaser and the User by using the Gift Card declare that they have read the Regulations and accept their content.
  4. The Exhibitor reserves the right to change the content of the Regulations if the need to make changes results from factors beyond the Exhibitor's control. The Exhibitor will inform about the change of the Regulations by posting the changed Regulations on the website: https://www.posterimo.com/ , together with information from when the changed Regulations are in force.
  5. In the event of a change to the Regulations, the previously applicable content of the Regulations shall apply to Gift Cards issued before the date of entry into force of the amended Regulations. The amended Regulations shall apply only to Gift Cards issued after their entry into force.
  6. In all matters not regulated in these Regulations, the relevant provisions of generally applicable law and the Regulations of the Online Store shall apply.
  7. These Regulations are effective from 03/04/2024 at 8:00 p.m.
